Warner Bros. TV has found itself in the midst of a legal battle following a lawsuit filed by the widow of a renowned author. The lawsuit claims that the studio’s upcoming medical procedural, The Pitt, is essentially a reboot of the iconic series ER. The lawsuit accuses executive producer John Wells and star Noah Wyle of a “personal betrayal,” alleging that they developed The Pitt after plans to reboot ER were blocked by the Crichton estate. The lawsuit emphatically states, “The Pitt is ER. It’s not like ER. It’s not kind of ER. It’s not sort of ER. It is ER with the exact same executive producer, writer, star, production companies, studio, and network as the planned ER reboot.”
However, insiders argue that the similarities between ER and The Pitt are superficial. While both shows are set in emergency rooms and involve Wells and Wyle, The Pitt is said to explore different themes and adopt a distinct tone.
A fresh take on medical dramas
The Pitt is set in Pittsburgh, unlike ER, which was based in a Chicago hospital. The new show promises no repeat characters or iconography from ER. Moreover, the series will be available on the streaming platform Max, featuring 15 episodes per season, a departure from the original 22-episode seasons of ER on NBC. This shift to streaming allows for more explicit themes and a more adult-oriented narrative.
“Another advantage that you have in doing these shows for streaming is that you don’t have the same kind of broadcast standards that you have to meet,” Wells mentioned in a previous interview. “There is a willingness to have a more adult version of what was able under FCC rules to be done on broadcast television. So, one of the things that we got excited about with The Pitt is we could tell medical stories in which they actually look like what really happens in the hospital — and the way in which people actually interact with the healthcare system.”
The evolution of medical shows
Wells initially approached Warner Bros. TV with the idea of revisiting the medical genre in the post-COVID era, focusing on the changes in hospitals and emergency rooms during and after the pandemic. When a deal with the Crichton estate couldn’t be reached, the producers decided to develop a new medical show independent of the ER franchise.
It’s worth noting that medical procedurals have been a staple of television for decades. The year ER premiered on NBC, CBS aired another hospital show set in Chicago, Chicago Hope. This context highlights that the medical drama genre is broad and diverse, with room for multiple interpretations and narratives.

The Pitt stars Noah Wyle, known for his role in ER, and features a talented ensemble cast, including Tracy Ifeachor, Patrick Ball, Supriya Ganesh, Fiona Dourif, Taylor Dearden, Isa Briones, Gerran Howell, Shabana Azeez, and Katherine LaNasa. The series is written by R. Scott Gemmill, who will also serve as an executive producer alongside Wyle, John Wells, Erin Jontow, Simran Baidwan, and Michael Hissrich. Warner Bros.
